Welcome to RESH Cookware ("RESH," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website at reshcookware.com (the "Site") and all purchases made through it. By accessing our Site or placing an order, you agree to be bound by these Terms in full. If you do not agree, please do not use our Site.

1. About RESH

RESH is a direct-to-consumer cookware brand based in the United Arab Emirates. We design, market, and sell titanium cookware products. All transactions are processed through our Shopify-hosted storefront.

2. Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction) to make a purchase. By placing an order, you represent and warrant that you meet this requirement and that all information you provide is accurate, current, and complete.

3. Products and Descriptions

We make every effort to display our products accurately, including materials, dimensions, and specifications. However, we do not warrant that product descriptions, photographs, pricing, or other content on the Site are error-free, complete, or current. Colors may vary slightly due to monitor calibration and photography. If a product you receive differs materially from its description, your sole remedy is set out in our Return and Refund Policy.

4. Pricing and Payment

All prices are listed in the currency displayed at checkout and are subject to change without notice. Prices do not include customs duties, import taxes, or local value-added taxes that may be imposed by your country of delivery — those charges are your responsibility. We accept payment methods displayed at checkout. Payment is processed at the time of order. We reserve the right to refuse or cancel any order for any reason, including pricing errors, suspected fraud, or product unavailability. If we cancel your order after payment has been taken, we will issue a full refund.

5. Orders and Acceptance

Placing an order constitutes an offer to purchase. We are not obligated to accept any order. Order confirmation emails are acknowledgments of receipt, not acceptance. Acceptance occurs only when we dispatch the product. We reserve the right to limit order quantities and to refuse service to anyone at our discretion.

6. Shipping and Delivery

Shipping terms, estimated delivery times, and any applicable fees are described in our Shipping Policy. Delivery estimates are not guaranteed and may be affected by factors beyond our control, including customs processing, carrier delays, weather, and public holidays. Risk of loss and title for products pass to you upon delivery to the carrier. We are not liable for delays or losses caused by shipping carriers or customs authorities.

7. Returns and Refunds

Our Return and Refund Policy is incorporated into these Terms by reference. Please review it before making a purchase. We offer returns within 30 days of delivery for unused, undamaged products in original packaging. Certain conditions and exclusions apply as described in the Return and Refund Policy.

8. Lifetime Guarantee

RESH products are backed by a Lifetime Guarantee against defects in materials and workmanship under normal household use. This guarantee covers structural failure of the pan body, delamination of the 3-ply construction, and defects in the handle attachment. This guarantee does not cover: normal wear and tear (scratches, discoloration, patina development); damage from misuse, abuse, neglect, or accidents; damage from use in commercial or institutional settings; cosmetic changes that do not affect performance; damage resulting from failure to follow our Care Guide; or modifications or repairs attempted by anyone other than RESH. To make a claim, contact us with your order number and photographs of the defect. We will, at our sole discretion, repair, replace, or refund the product. This guarantee is non-transferable and applies only to the original purchaser. This guarantee does not limit any statutory rights you may have under applicable consumer protection laws.

9. Product Use and Safety

RESH cookware is designed for normal household cooking use. You are responsible for using the product safely and in accordance with our Care Guide. We are not responsible for injuries, damages, or losses arising from misuse, improper handling, or failure to follow our care instructions. Our products are not intended for use in commercial kitchens, industrial settings, or any purpose other than domestic cooking.

10. Intellectual Property

All content on this Site — including text, images, graphics, logos, videos, product designs, and the RESH brand name — is the exclusive property of RESH or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, display, or create derivative works from any content on this Site without our prior written consent. The RESH name, logo, and all related marks are trademarks of RESH. Unauthorized use is strictly prohibited.

11. User Content

If you submit reviews, comments, photographs, or other content ("User Content") to our Site, you grant RESH a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, display, and distribute that content in any medium for any purpose, including marketing and advertising. You represent that you own the rights to any User Content you submit and that it does not violate any third-party rights or applicable laws. We reserve the right to remove any User Content at our discretion.

12. Privacy and Data Protection

Your use of our Site is also governed by our Privacy Policy. We collect, process, and store personal data in accordance with applicable data protection laws, including the UAE Federal Decree-Law No. 45 of 2021 on Personal Data Protection, the EU General Data Protection Regulation (GDPR) where applicable, and other relevant legislation. By using our Site, you consent to the collection and use of your data as described in our Privacy Policy.

13. Limitation of Liability

To the maximum extent permitted by applicable law, RESH and its officers, directors, employees, agents, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of our Site or products, whether based on warranty, contract, tort (including negligence), or any other legal theory. Our total aggregate liability for any claim arising out of or relating to these Terms or our products shall not exceed the amount you paid for the specific product giving rise to the claim. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.

14. Indemnification

You agree to indemnify, defend, and hold harmless RESH and its officers, directors, employees, agents, and suppliers from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: your breach of these Terms; your use of our Site or products; your violation of any law or third-party rights; or any User Content you submit.

15. Disclaimers

The Site and all products are provided "as is" and "as available" without warranties of any kind, except as expressly stated in these Terms or required by law. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement, to the extent permitted by law. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or harmful components. Material information and product claims on our Site (including material composition, construction details, and performance characteristics) are provided in good faith based on manufacturer specifications and testing. We do not make medical claims about our products.

16. Force Majeure

RESH shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, pandemics, war, terrorism, government actions, supply chain disruptions, carrier failures, or utility outages.

17. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the competent courts of the United Arab Emirates. Nothing in this clause limits your statutory right to bring proceedings in your country of residence where required by applicable consumer protection law.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, and Return and Refund Policy, constitute the entire agreement between you and RESH regarding your use of the Site and purchase of our products. These Terms supersede all prior agreements and communications.

20. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes take effect when posted on this page. Your continued use of the Site after changes constitutes acceptance. We encourage you to review these Terms periodically.
